EB-1 Employment-Based Immigrant Visas (Green Cards)
The EB-1 category for “priority workers” is divided into three categories:
EB-1-1 – Aliens of extraordinary ability
- No job offer required
- At the top of his or her field and/or have received national or international acclaim in the sciences, arts, education, business or athletics
EB-1-2 – Outstanding Professors and Researchers
- Job offer required
- Internationally recognized as outstanding
- At least three years of experience in teaching or research
EB-1-3 – Multinational Executives and Professors
- Employed for one of the last three years abroad by affiliate, subsidiary or parent of U.S. entity
- U.S. company must have been in business for at least one year
- Employed both abroad and in the United States in a managerial/executive capacity
- Similar to the L-1A non-immigrant visa category
Advantages:
- No labor certification requirement;
- Visa number (the “priority date”) is immediately available; and
- The I-140 Petition (Petition for Alien Worker) and I-485 (Adjustment Application) can be filed concurrently.
